Welcome to Flarewifi. These Terms and Conditions ("Terms") govern your access to and use of the Flarewifi website, products, and services operated by Flarego Technologies Corp. ("Flarewifi," "we," "us," or "our").
By accessing our website, purchasing our products, creating an account, or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
These Terms apply to all users, including operators (business customers running hotspots) and end users (consumers connecting to hotspots). Please also review our Privacy Policy, which describes how we collect and use your information.
Definitions
Throughout these Terms, the following definitions apply:
- "Flarewifi," "We," "Us," "Our" refers to Flarego Technologies Corp. and its affiliates.
- "Services" refers to the Flarewifi website, hardware products, cloud management platform, and WiFi hotspot access.
- "User," "You," "Your" refers to any individual or entity accessing or using our Services.
- "Operator" refers to business customers who purchase and operate Flarewifi hotspots.
- "End User" refers to consumers who connect to and use Flarewifi hotspots.
- "Products" refers to physical hardware, including WiFi routers and related equipment.
- "Platform" refers to the Flarewifi cloud management dashboard and related software.
Services Overview
Flarewifi provides the following services:
- Hardware Sales: WiFi routers and related equipment for setting up hotspot businesses.
- Cloud Management Platform: An online dashboard for operators to manage their hotspots, monitor usage, and configure settings.
- End-User WiFi Access: Internet connectivity for consumers through Flarewifi-powered hotspots.
We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice.
Account Registration
To access certain features of our Services, you may need to create an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Keep your login credentials secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access or security breach
You may only maintain one account per person or entity. We reserve the right to refuse registration or cancel accounts at our discretion.
Hardware Purchases
When you purchase Products from Flarewifi, the following terms apply:
Product Information
We strive to provide accurate product descriptions and images. However, we do not warrant that descriptions, pricing, or other content is error-free. We reserve the right to correct errors and update information at any time.
Order Acceptance
Your order constitutes an offer to purchase. We reserve the right to accept or decline any order. An order is only confirmed when we send you an order confirmation. We may cancel orders due to pricing errors, product unavailability, or suspected fraud.
Shipping and Delivery
Shipping times and costs vary based on your location. Risk of loss and title for Products pass to you upon delivery to the carrier. You are responsible for inspecting Products upon delivery and reporting any damage or discrepancies promptly.
Resale Restrictions
Products purchased from Flarewifi may not be resold without prior written authorization. If you are interested in becoming an authorized reseller, please contact us through our contact form.
Subscription Services
Access to certain features of the Flarewifi cloud platform may require a paid subscription. The following terms apply to subscription services:
Billing and Renewal
Subscriptions are billed on a recurring basis (monthly or annually, depending on your plan). Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date.
Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of your current billing cycle. No prorated refunds will be provided for the remaining period.
Plan Changes
We may change subscription plans, pricing, or features at any time. We will notify you of material changes before they take effect. Continued use of the subscription after changes constitutes acceptance of the new terms.
Payment Terms
The following payment terms apply to all purchases:
- Prices are displayed in Philippine Peso (PHP) or US Dollars (USD), depending on your location and selected currency.
- Payment is due at the time of purchase for hardware orders and at the start of each billing cycle for subscriptions.
- We accept major credit cards, debit cards, and other payment methods as displayed at checkout.
- You are responsible for any applicable taxes, duties, or fees associated with your purchase.
- If a payment fails, we may suspend your access to subscription services until payment is received.
Refunds and Returns
Hardware Returns
You may return hardware Products within 7 days of delivery, subject to the following conditions:
- Products must be unused, in original packaging, and in resalable condition
- Defective products may be returned regardless of condition
- You are responsible for return shipping costs unless the product is defective
- Refunds will be processed within 14 business days of receiving the returned product
- Refunds will be issued to the original payment method
Subscription Refunds
Subscription fees are non-refundable. When you cancel a subscription, you will continue to have access until the end of your current billing cycle, but no refund will be provided for the remaining period.
How to Request a Return
To initiate a return, please contact us through our contact form within the 7-day return window. Include your order number and reason for return.
Warranty
Limited Warranty
Flarewifi hardware Products are covered by a 1-year limited warranty from the date of purchase. This warranty covers defects in materials and workmanship under normal use.
What Is Covered
- Manufacturing defects
- Hardware malfunctions under normal operating conditions
- Component failures not caused by external factors
What Is Not Covered
- Damage caused by misuse, abuse, or neglect
- Unauthorized modifications or repairs
- Damage from power surges, lightning, or electrical issues
- Water damage or exposure to extreme conditions
- Normal wear and tear
- Damage caused by natural disasters or acts of God
Warranty Claims
To make a warranty claim, contact us through our contact form with your proof of purchase and a description of the issue. We will assess the claim and, if valid, repair or replace the product at our discretion.
Acceptable Use Policy
When using Flarewifi Services, you agree not to:
- Use the Services for any illegal, harmful, or fraudulent activities
- Transmit malware, viruses, or other malicious code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the Services or other users' experience
- Consume excessive bandwidth in a manner that degrades service for others
- Resell, redistribute, or commercially exploit the Services without authorization
- Reverse engineer, decompile, or attempt to extract source code from our software
- Use the Services to infringe on intellectual property rights
- Engage in any activity that violates applicable laws or regulations
We reserve the right to monitor usage and take action against violations, including suspension or termination of access.
Intellectual Property
All content, trademarks, logos, software, and intellectual property associated with Flarewifi are owned by or licensed to Flarego Technologies Corp. This includes:
- The Flarewifi name, logo, and branding
- Website design, content, and graphics
- Software, firmware, and platform code
- Documentation and marketing materials
You are granted a limited, non-exclusive, non-transferable license to use our Services for their intended purpose. You may not copy, modify, distribute, or create derivative works without our written permission.
Limitation of Liability
To the maximum extent permitted by law:
- Our total liability to you for any claims arising from these Terms or your use of the Services shall not exceed the total amount you paid to us in the 12 months preceding the claim.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
- We are not responsible for service interruptions, network downtime, or data loss beyond our reasonable control.
Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you.
Disclaimer of Warranties
Except for the express limited warranty on hardware Products, our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the Services will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy or reliability of any information obtained through the Services
We do not guarantee any specific uptime or availability. Network performance may vary based on factors beyond our control.
Account Termination
We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, with or without cause, and with or without notice. Reasons for termination may include:
- Violation of these Terms or the Acceptable Use Policy
- Fraudulent or illegal activity
- Non-payment of fees
- Extended inactivity
- Any other reason at our discretion
You may close your account at any time through your account settings. Upon termination, your right to use the Services ceases immediately. We may delete your data in accordance with our Privacy Policy. No refunds will be provided upon termination.
Dispute Resolution
If a dispute arises between you and Flarewifi, we encourage you to resolve it through the following process:
Step 1: Contact Us
First, reach out to us through our contact form. Many issues can be resolved through good-faith communication. We will respond within 30 days.
Step 2: Mediation
If we cannot resolve the dispute directly, either party may request mediation. Both parties agree to participate in good-faith mediation before pursuing formal legal action.
Step 3: Legal Proceedings
If mediation fails, disputes shall be resolved in the courts of Cebu, Philippines. Both parties consent to the exclusive jurisdiction of these courts.
Governing Law: These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines.
Changes to Terms
We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. When we make significant changes, we will:
- Update the "Last updated" date at the top of this page
- Notify you via email or through our Services for material changes
- Provide reasonable notice before changes take effect
Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Flarewifi regarding the Services.
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
- Assignment: You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights at any time without notice.
- Force Majeure: We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, war, or government actions.
- No Third-Party Beneficiaries: These Terms do not create any rights for third parties.
